Services: All gardening-related services provided by Gardening Bermondsey, including but not limited to lawn care, planting, garden design, maintenance, and landscaping.

2. Description of Services

Gardening Bermondsey offers a comprehensive range of gardening services designed to meet the diverse needs of our clients. Our services include:

Lawn Care: Regular mowing, trimming, fertilizing, aeration, and pest control to maintain a healthy and vibrant lawn.
Planting: Selection, planting, and maintenance of flowers, shrubs, trees, and other plants to enhance the beauty and functionality of your garden.
Garden Design: Customized garden layouts and designs that reflect your personal style and preferences while optimizing space and resources.
Maintenance: Ongoing garden upkeep including weeding, pruning, mulching, and seasonal adjustments to ensure your garden remains in pristine condition.
Landscaping: Comprehensive landscaping services including hardscaping, installation of garden structures, water features, and more.

3. Client Obligations

As a client of Gardening Bermondsey, you agree to the following obligations:

Accurate Information: Provide accurate and complete information regarding your garden space, existing structures, and specific requirements.
Access: Ensure that our team has appropriate access to your property to perform the services as agreed.
Payment: Remit payment for services rendered in accordance with the payment terms outlined in Section 4.
Compliance: Ensure that the use of our services does not violate any local laws or regulations.

4. Payment Terms

Our payment terms are designed to ensure clarity and fairness for both parties:

Pricing: Services are priced based on the scope of work, materials required, and time involved. A detailed quotation will be provided prior to commencement of services.
Invoicing: Invoices are issued upon completion of services or as otherwise agreed upon in writing.
Payment Methods: We accept various payment methods including bank transfers, credit/debit cards, and checks.
Payment Due Date: Payments are due within 30 days of the invoice date unless otherwise specified.
Late Payments: Late payments may incur a fee of 2% per month on the outstanding balance.
Deposit: For large projects, a deposit may be required to secure services. The amount will be specified in the quotation.

5. Cancellation and Refund Policy

We understand that circumstances may change. Our cancellation and refund policy is as follows:

Cancellation Notice: Clients may cancel services with a minimum of 14 days notice without incurring any penalties.
Late Cancellations: Cancellations made less than 14 days before the scheduled service may incur a fee equivalent to 50% of the service cost.
Refunds: Refunds for prepaid services will be processed within 30 days of cancellation, less any applicable fees.
Rescheduling: Clients may request to reschedule services without penalty, subject to availability.

6. Liability and Indemnification

Our liability and indemnification terms are established to protect both Gardening Bermondsey and our clients:

Limitation of Liability: Gardening Bermondsey shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.
Maximum Liability: Our maximum liability shall not exceed the total amount paid by the client for the specific service in question.
Indemnification: Clients agree to indemnify and hold harmless Gardening Bermondsey from any claims, damages, or expenses arising out of the client's misuse of the services.

7. Intellectual Property

All materials, including designs, plans, and documents provided by Gardening Bermondsey, are the intellectual property of Gardening Bermondsey and are protected by applicable laws.

Usage Rights: Clients are granted a non-exclusive, non-transferable license to use the provided materials for their personal or business purposes.
Restrictions: Clients may not reproduce, distribute, or modify any materials without prior written consent from Gardening Bermondsey.

8. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the course of the services.

Obligation: Neither party shall disclose confidential information to any third party without the express written consent of the other party.
Exclusions: Confidential information does not include information that is publicly available or rightfully obtained from a third party.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

Jurisdiction: Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Compliance: Both parties agree to comply with all applicable laws and regulations in the performance of their obligations.

10. Amendments to Terms

Gardening Bermondsey reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of the services constitutes acceptance of the updated terms.

Notification: Clients will be notified via email or through our official communication channels.
Effective Date: Amendments will take effect immediately upon posting unless otherwise specified.

11. Termination

These Terms and Conditions remain in effect until terminated by either party.

Client Termination: Clients may terminate the agreement as outlined in the Cancellation Policy (Section 5).
Provider Termination: Gardening Bermondsey reserves the right to terminate services if the client breaches any terms outlined in these conditions.
Effect of Termination: Upon termination, all pending payments become immediately due, and any materials provided remain the property of Gardening Bermondsey.

12. Force Majeure

Gardening Bermondsey shall not be held liable for any failure to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, or unforeseen technical issues.

Notification: In the event of a force majeure situation, Gardening Bermondsey will notify the client as soon as possible.
Obligations: Both parties agree to make reasonable efforts to mitigate the impact of the force majeure event.

13. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Interpretation: The invalidity of one clause does not affect the validity of other clauses.
Adjustment: Invalid provisions will be replaced with valid ones that most closely reflect the original intent.

14. Entire Agreement

These Terms and Conditions constitute the entire agreement between Gardening Bermondsey and the client regarding the use of services, superseding all prior agreements and understandings.

Integration: No other agreements, whether written or oral, are considered part of this agreement unless explicitly stated.
Modification: Any modifications to this agreement must be made in writing and signed by both parties.

15. Privacy Policy

Gardening Bermondsey is committed to protecting the privacy of our clients. Any personal information collected will be used solely for the purpose of providing our services.

Data Protection: All personal data is stored securely and is only accessible to authorized personnel.

16. Feedback and Complaints

We value client feedback and aim to resolve any complaints promptly and effectively.

Feedback: Clients are encouraged to provide feedback on our services to help us improve.
Complaints Procedure: Any complaints should be submitted in writing to our designated contact person. We will acknowledge all complaints within 5 business days and strive to resolve them within 30 days.

17. Independent Contractors

All personnel providing services on behalf of Gardening Bermondsey are considered independent contractors and are not employees.

Responsibility: Independent contractors are responsible for their own taxes, insurance, and compliance with applicable laws.
No Employment Relationship: These Terms do not create an employment relationship between Gardening Bermondsey and clients.

18. Assignment

Clients may not assign or transfer their rights or obligations under these Terms without the prior written consent of Gardening Bermondsey.

Transfer Restrictions: Any attempt to assign rights without consent is void and unenforceable.
Gardening Bermondsey Rights: We may assign our rights and obligations to a third party in the event of a merger, acquisition, or sale of assets.

19. Notices

All notices or communications required under these Terms must be in writing and will be deemed delivered upon receipt.

Delivery Methods: Notices can be delivered via email, postal mail, or other agreed-upon methods.
Contact Information: Clients must ensure that their contact information is up-to-date to receive timely notices.

20. No Waiver

The failure of either party to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Enforcement: Rights and provisions remain enforceable despite any failure to enforce them previously.
Partial Waiver: A waiver of any part of these Terms does not waive any other part.

21. Headings

The headings used in these Terms are for convenience only and do not affect the interpretation of the provisions.

Interpretation: Headings do not constitute part of the Terms and should not influence the meaning of any section.
